These Terms of Service ("Terms") govern the use of services provided by Rebel Marketing ("we", "our", "us") through RebelPages.my.
By purchasing, subscribing to, accessing, or using any RebelPages service, the Client agrees to be bound by these Terms.
1. Services
RebelPages provides website design, website setup, website hosting, website maintenance, digital business infrastructure, and related services for cafes, restaurants, and small businesses.
Services provided shall be limited to the package purchased by the Client.
Any work outside the purchased package scope may be quoted separately and billed as additional work.
2. Project Commencement
A project is considered commenced only after:
- Full payment has been received.
- Required onboarding forms have been completed.
- All requested content has been submitted.
- All required images, menus, branding assets, and business information have been received.
- Required account access credentials have been provided, where applicable.
Failure to provide required information may delay project commencement.
3. 72-Hour Delivery Commitment
The advertised 72-hour delivery commitment begins only after all requirements listed in Section 2 have been fulfilled.
The delivery timeline shall automatically be extended where delays arise due to:
- Incomplete information.
- Late client responses.
- Changes requested after work has commenced.
- Hosting provider issues.
- Domain provider issues.
- Third-party software issues.
- Plugin conflicts.
- Payment gateway delays.
- Internet outages.
- Government restrictions.
- Cybersecurity incidents.
- Force majeure events.
- Any circumstances beyond the reasonable control of Rebel Marketing.
Rebel Marketing shall not be liable for delays arising from such circumstances.
The 72-hour commitment refers to the initial website delivery and does not include revision periods.
4. Client Responsibilities
The Client agrees to:
- Provide accurate information.
- Supply content in a timely manner.
- Respond to requests for clarification promptly.
- Ensure ownership or permission for all supplied content.
- Review deliverables within the stated review period.
The Client remains solely responsible for the accuracy and legality of all content supplied.
5. Revisions
Starter Package includes one (1) revision round.
Growth Package includes two (2) revision rounds.
AI Growth Package includes three (3) revision rounds.
A revision round means one consolidated list of requested changes.
Additional revisions may be charged at prevailing rates.
Requests outside the package scope shall be treated as additional work.
6. Project Approval
The Client shall review all deliverables within seven (7) calendar days of delivery.
If no feedback is received within seven (7) calendar days, the project shall be deemed approved and completed.
7. Scope Changes
Any request outside the purchased package scope may incur additional charges.
Examples include:
- Additional pages.
- New functionality.
- Ecommerce features.
- Booking systems.
- Membership systems.
- Custom integrations.
- Additional content creation.
- Additional design work.
Rebel Marketing reserves the right to quote separately for such requests.
8. Abandoned Projects
Projects with no response or communication from the Client for thirty (30) consecutive days may be considered abandoned.
Abandoned projects may be closed without refund.
Reactivation may require additional fees.
9. Hosting Services
Where hosting is included, hosting services are provided on a best-effort basis.
Rebel Marketing does not guarantee uninterrupted service availability.
Scheduled maintenance, emergency maintenance, third-party failures, and circumstances beyond our control may result in temporary service interruptions.
10. Third-Party Services
RebelPages websites may integrate with third-party providers including:
- WhatsApp.
- Google Business Profile.
- Google Maps.
- Domain registrars.
- Hosting providers.
- WordPress plugins.
- Analytics providers.
- Payment gateways.
Rebel Marketing is not responsible for outages, suspensions, policy changes, API changes, pricing changes, restrictions, or service interruptions imposed by third-party providers.
11. Intellectual Property
Upon full payment, ownership of client-specific website content transfers to the Client.
Rebel Marketing retains ownership of:
- Website frameworks.
- Templates.
- Design systems.
- Internal processes.
- Development methodologies.
- Reusable components.
- Code libraries.
- Automation systems.
- Proprietary assets.
Nothing in these Terms transfers ownership of Rebel Marketing intellectual property.
12. Portfolio Rights
Unless otherwise agreed in writing, Rebel Marketing may display completed projects in its portfolio, website, social media channels, presentations, case studies, and marketing materials.
13. Payment
All fees are payable in advance unless otherwise agreed in writing.
Failure to pay renewal fees may result in suspension or termination of services.
14. Suspension of Services
Rebel Marketing reserves the right to suspend services where:
- Payments are overdue.
- The Client breaches these Terms.
- Illegal or prohibited activities are detected.
Services may remain suspended until the issue is resolved.
15. Limitation of Liability
To the fullest extent permitted by Malaysian law, Rebel Marketing shall not be liable for:
- Loss of profits.
- Loss of revenue.
- Loss of business opportunities.
- Loss of data.
- Indirect damages.
- Consequential damages.
Our total liability shall not exceed the amount paid by the Client for the specific service giving rise to the claim.
16. Indemnity
The Client agrees to indemnify and hold harmless Rebel Marketing against claims, damages, losses, liabilities, and expenses arising from:
- Client-supplied content.
- Copyright infringement.
- Trademark infringement.
- Misleading information.
- Illegal business activities.
17. Force Majeure
Rebel Marketing shall not be liable for any delay or failure caused by events beyond its reasonable control including:
- Natural disasters.
- Floods.
- Fires.
- Epidemics.
- Cyber attacks.
- Government actions.
- Internet outages.
- Hosting failures.
- Third-party service disruptions.
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Malaysia.
The parties agree to first attempt to resolve disputes through good faith discussions before commencing legal proceedings.
Any dispute that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of Malaysia.
19. Changes to Terms
Rebel Marketing reserves the right to update these Terms at any time.
The latest version published on RebelPages.my shall apply.
